REGULATIONS OF THE ONLINE STORE

§1. General provisions

The online store available at the address: http://www.inkandelas.com is operated by INKANDELAS, conducting business under the name Sebastian Rivera Studio with its registered office at ul. Krzywe Koło 2/4, 00-270 Warsaw, NIP: 5223092757, REGON: 36737124900000, hereinafter referred to as the "Seller".

The regulations define the rules for using the online store, placing orders, concluding sales agreements, the rights and obligations of the parties, and the procedure for complaints and withdrawal from the agreement.

The store sells artistic ceramics and jewelry through the Internet.

The regulations are provided free of charge on the store's website in a format that allows for downloading, saving, and printing.

§2. Definitions

  • Customer – a natural person, legal entity, or organizational unit making purchases in the store.

  • Consumer – a Customer who is a natural person making a purchase not directly related to business or professional activity.

  • Store – the online service operated by the Seller.

  • Product – ceramics or jewelry offered in the store.

  • Sales agreement – an agreement concluded between the Customer and the Seller via the store.

§3. Placing orders

  • Orders can be placed 24 hours a day via the store's website.

  • To place an order, the Customer:a) selects the Product,b) adds it to the cart,c) fills out the order form,d) chooses the payment and delivery method,e) accepts the Regulations and places the order.

  • Placing an order constitutes an offer to conclude a sales agreement.

  • The agreement is concluded upon confirmation of the order by the Seller via email.

§4. Prices and payments

  • All prices listed in the store are gross prices (including VAT), unless stated otherwise.

  • Prices do not include delivery costs, which are provided when placing the order.

  • Available payment methods:a) traditional bank transfer to the Seller's account,b) online payments via Przelewy24,c) Autopay,d) other forms indicated on the store's website.

  • In the case of online payments (Przelewy24 or Autopay), the Customer is redirected to the payment operator's page, where they make the payment according to the operator's regulations. The Seller does not store card data or Customer passwords.

  • The Seller reserves the right to change prices, provided that changes do not apply to orders already placed and paid.

§5. Delivery

  • Delivery is carried out on the territory of [Poland / EU].

  • Available delivery methods are indicated on the store's website.

  • The order fulfillment time is from 1 to 3 business days, unless otherwise specified in the product description (e.g., custom-made products).

  • The Seller is not responsible for delays caused by the carrier.

§6. Handmade products

The products offered in the store are handmade, therefore they may slightly differ in color, shape, or texture from the images presented on the site. Such differences do not constitute a defect in the product.

§7. Right of withdrawal from the agreement

  • The consumer has the right to withdraw from the agreement within 14 days of receiving the product, without giving any reason.

  • To exercise the right of withdrawal, the Consumer should submit a clear statement, e.g., by email, to the email address: inkandelas@gmail.com

  • The product should be returned to the company's address: Sebastian Rivera Studio, ul. Krzywe Koło 2/4, 00-270 Warsaw, Poland

  • The product must be returned in its original condition, unless the change was necessary to ascertain the nature of the product.

  • The right of withdrawal does not apply to products made to individual order.

§8. Complaints

  • The Seller is responsible for product defects under the principles set out in the Civil Code.

  • Complaints should be submitted by email to the address inkandelas@gmail.com or in writing to the address: Sebastian Rivera Studio, ul. Krzywe Koło 2/4, 00-270 Warsaw, Poland

  • The complaint should include a description of the defect and the Customer's contact details.

  • The Seller will consider the complaint within 14 days.

§9. Personal data

  • The administrator of Customers' personal data is the Seller.

  • Personal data is processed solely for the purpose of order fulfillment and in accordance with applicable legal regulations.

  • Detailed information can be found in the Privacy Policy available on the store's website.

§10. Final provisions

  • The regulations are effective from February 1, 2026.

  • The Seller reserves the right to change the Regulations.

  • In matters not regulated, Polish law applies.

  • Disputes will be resolved by the competent common court.

 

§11. Privacy Policy

The administrator of personal data of customers using the Store is Sebastian Rivera Studio (INKANDELAS), with its registered office at ul. Krzywe Koło 2/4, 00-270 Warsaw, NIP: 5223092757, REGON: 36737124900000, hereinafter referred to as the "Administrator."

The Administrator processes customers' personal data in accordance with the provisions of:

  • Regulation of the European Parliament and of the Council (EU) 2016/679 (GDPR),

  • the Act on the Provision of Electronic Services,

  • the Act on Personal Data Protection.

Scope of processed data

When using the Store, the following personal data of the customer may be processed:

  • first and last name

  • delivery address

  • email address

  • phone number

  • invoice data

  • IP address

  • order data

Providing data is voluntary, but necessary for the order to be fulfilled.

Purpose of data processing

Customers' personal data is processed for the purpose of:

  • fulfilling the order and concluding the sales contract,

  • handling payments,

  • executing delivery,

  • handling complaints and returns,

  • contacting the customer,

  • conducting accounting,

  • potentially pursuing claims.

Legal basis for processing

Personal data is processed based on:

  • art. 6 sec. 1 lit. b GDPR – execution of the sales contract,

  • art. 6 sec. 1 lit. c GDPR – legal obligations (e.g., tax obligations),

  • art. 6 sec. 1 lit. f GDPR – legitimate interest of the Administrator.

Data recipients

Personal data may be transferred to entities cooperating with the Administrator only to the extent necessary for the fulfillment of the order, in particular:

  • payment operators Przelewy24 and Autopay,

  • courier companies and postal operators,

  • entities providing accounting services,

  • IT and hosting service providers.

Payment operators process data in accordance with their regulations and privacy policies.

Data retention period

Personal data is retained for the period:

  • necessary to fulfill the order,

  • required by tax and accounting regulations,

  • until the expiry of claims arising from the contract.

User rights

Every customer has the right to:

  • access their data,

  • rectify their data,

  • delete their data,

  • limit processing,

  • data portability,

  • object to data processing.
